Study Permit- Regular Stream

A study permit allows you to legally study in Canada for the duration of the study permit that was issued to you. Generally, study permits are issued for studies that are 6 months or longer depending on the duration of your program, your passport validity or other factors. If your program is shorter than 6 months, then you will not need a study permit. Although you might need a temporary resident visa to enter and remain in Canada on a valid status. Depending on your nationality you may be required to obtain an eTa or a visa.

Having a Canadian education comes with its many benefits. Canada allows its valid study permit holders to work up to 20 hours a week while studying and full-time during breaks without a need of work permit. Requirements

  • Be enrolled at a Designated Learning Institution.
  • Have enough funds to cover your tuition fees, living expenses and transportation.

Student Direct Stream

Depending on the country of your residence, you may be eligible to apply under Student Direct Stream (SDS). SDS Category has become very attractive for the residents of certain eligible countries as it provides faster processing times. Under this program if you are eligible, your application can be processed in just 20 days. Applications under SDS can be complex as there are additional requirements compared to the regular stream. It is very important to gather and submit the necessary documents to avoid refusal of an application and unwanted delays.   • Guaranteed Investment Certificate (GIC) of $10,000.

Decide Your Program of Study and Institution

Eligibility Requirements

There are 4 requirements that entrepreneurial applicants must meet in order to qualify under the start-up visa program.

1. Have a Qualifying Business

  1. At the time of getting the commitment from Designated Organizations.
    • Entrepreneur applicants must have created a business in which each applicant for immigration holds at least 10 percent of the voting rights attached to all shares of the corporation outstanding at that time
    • Up to five newcomers can apply together as owners. As well, the applicants and the designated organization must jointly hold more than 50 percent of the total voting rights.
  2. At the time of obtaining the Permanent Residence:
    • In order to secure permanent residence through the Start-up Visa Program, applicants must ensure that the business becomes incorporated within Canada with essential activities taking place in Canada through the active management of the foreign entrepreneurs

2. Obtain and Secure Commitment Letter from a Designated Organization

Before applying to the Start-up Visa Program, foreign entrepreneurs must secure the commitment of a designated organization that will support and invest in the business’ development in Canada. Designated Organizations are business groups approved by the Government of Canada to make investments or to support start-up businesses.

There are three categories of designated organizations:

  • Designated Angel Investor Groups
  • Designated Venture Capital Funds
  • Designated Business Incubators

3. Meet the Language Proficiency Requirements.

You must obtain a minimum score of Canadian Language Benchmark (CLB) 5 in either English or French in order to meet the program requirements.

You must have CLB 5 in all four areas of the test which are:

  • Speaking
  • Listening
  • Reading, and
  • Writing.

4. Have Sufficient Funds to Settle in Canada

At the time of the application you will have to prove to the Government that you have sufficient funds available to support yourself and your family. These funds cannot be assets and cannot be borrowed from family or friends. The amount you will need to provide will depend on the size of your family. Interim Work Permit With Start Up Visa

Since this application process is lengthy, we assist our clients to apply for a temporary work permit that allows them to come to Canada and start setting up the business. You can only apply for this short term work permit after you obtain the commitment letter and the letter of support from the designated organization.

Self Employed Persons

Canada welcomes people with different work experiences by offering them different pathway options to obtain Permanent Residency Status. Candidates with a background of cultural and athletic activities do not always qualify under the Express Entry programs and Canada recognizes that. In order to promote the cultural and athletic activities, the government has launched a Self Employment Program that allows artists and athletes to become eligible for PR if certain conditions are met. Candidates under this program are subject to different selection factors. The Self Employed program has its unique points calculation system that ranks the candidates according to their experience, age, language proficiency, education, and adaptability. Under this program athletes and artists must have a relevant experience in cultural activities or athletics, and intend to make a significant contribution to Canada.

Eligibility Requirements

  • Have relevant work experience:
    • Cultural Activities:
      • 2 one-year periods being self-employed in cultural activities, or
      • 2 one-year periods participating at a world-class level in cultural activities, or
      • a combination of a one-year period described above
    • Athletics:
      • 2 one-year periods being self-employed in athletics, or
      • 2 one-year periods participating at a world class level in athletics, or
      • a combination of a one-year period described above.
  • Be admissible to Canada on health and security grounds.
  • Must score at least 35 points out of 100 of the selection grid.

Provincial Nominee Programs for Investors

Under the Provincial Nominee Programs, certain provinces and territories provide the opportunity for international investors to apply for Permanent Residency through the province’s investor or entrepreneur streams. Post-Graduation Work Permit- PGWP

This program under Canada’s Immigration system, allows international students who graduated from a Canadian Designated Learning Institution to stay in Canada and gain Canadian work experience for up to 3 years. This permit allows graduates to enter the Canadian labour market that transitions them to the permanent residency pathway. It is important to note that not every Designated Learning Institution makes you eligible to obtain a Post-Graduation Work Permit. Eligibility Requirements

  • Must have completed a program of minimum of 8 months and awarded a degree, diploma or certificate.
  • Completion of full-time study, for the entire duration of the program.

Important things to know before you apply for PGWP

  • Have a valid study permit;.
  • Must be minimum 18 years of age.
  • Apply for PGWP within 180 days of receiving your final marks.
  • You must have graduated.
  • Any other conditions imposed by IRCC at time of submission

Spousal Open Work Permit

As Canada welcomes many students and talented temporary foreign workers each year, it also ensures that the families are not separated. Hence, Canadian Immigration allows the spouses or common law partners of the students or workers to legally study or work in Canada for the duration of their stay. This open work permit allows the spouse or common law partner who is accompanying, to work without the need of an LMIA. The open work permit allows the spouse of the student or the worker to work freely with any employer as it is not an employer specific work permit. One of the many benefits of this work permit is that it gives the opportunity for them to gain Canadian work experience and thereafter apply for Permanent Residency if they qualify. To be eligible to obtain a spousal open work permit, the person and the main applicant must meet certain requirements.

Eligibility Requirements

  • You are a spouse of a foreign worker in an occupation that is under the NOC Code skill type 0, A, or B that is for six months or longer.
  • You are a spouse of a student at a public post-secondary institution
  • You are a spouse of a foreign representative, or
  • You are a spouse of a foreign military member who is currently working in Canada

Business Visitor

Canada allows business visitors to enter Canada temporarily to take part in international business activities without entering or affecting the Canadian Labour Market. To qualify as a business visitor you may need to prove to the Immigration Officers that you are entering Canada based on a certain activity and that you will return back once your business activity is done. Business visitors and business people are not the same, therefore a business visitor must obtain proper authorization to enter Canada.

Eligibility Requirements:

  • Intention to stay in Canada less than 6 months.
  • Visit Canada to conduct business activities without entering the labour market
  • Have primary source of income outside of Canada
  • Have a valid travel document
  • Have sufficient funds for the duration of your stay
  • Be in good health and not be a health risk to Canadians
  • Have a clean criminal record
  • Show sufficient ties to your home country
  • Leave Canada at the end of your visit.

LMIA

The Labour Market Impact Assessment (LMIA)is a document issued by Employment and Skill Development Canada (ESDC) that provides options for temporary foreign workers to work in Canada. This option also allows students who are not eligible for PGWP due to any factors, to obtain an LMIA and then work.

The Labour Market Impact Assessment (LMIA) process is in place to prove that no Canadian citizen or permanent resident is ready, willing, and able to fill a specific position in Canada. In such a case, the employer is allowed to hire a foreign worker. Hiring a foreign national through LMIA can be complex as there are numerous program requirements to be met. LMIA applications are detailed and require lots of documentation and statistical tabulation. Depending on the type of the job, an employer can recruit and hire a temporary foreign worker under either low wage position or high wage position. Low wage LMIA is used when the employee is offered a wage that is below the median wage. The High wage LMIA is used when the employee is offered the median wage or higher. Upon receiving a positive LMIA, the employee can apply for an employer specific work permit.

Steps to apply for LMIA

In order to apply for an LMIA the employer must first prove that they have a functioning business that can support a Temporary Foreign Worker. The next step is to conduct recruitment efforts and see if there are any Canadian Citizens or Permanent Residents that are qualified enough or are willing to work in the job that is being offered by the employer. Only after the determination is made that there are no viable candidates, then an LMIA application is submitted for review. Hiring of a temporary foreign worker requires a detailed process and at Globus Immigration we are here to assist you at every step of the process.

Similar to the High-wage and Low-wage LMIA, in order for an employer to extend a permanent job offer to a temporary worker who is applying for a PR, they must conduct similar recruitment efforts. This LMIA is used for offering a permanent job offer to the employee to support their Permanent Residence application through Express Entry programs. By obtaining a positive LMIA for PR Support, the applicant receives additional 50 points towards their comprehensive ranking score that raises their overall score and ensures better ranking in the Express entry pool.

An Owner Operator LMIA is slightly different compared to the other LMIA types. This LMIA is focused more so on the business proposal rather than just offering a specific job to a single potential employee. There are many benefits to the owner operator LMIA, there are no recruitment efforts required for this LMIA and the person gets the freedom to operate their own business anywhere in Canada. To be eligible to immigrate through this route, you must satisfy important requirements related to business control and benefit to Canada through job creation and/ or skill transferability. Upon meeting all the requirements, the first step would be to apply for LMIA and then apply for a work permit upon receiving a positive LMIA.

This LMIA category can be considered as an investment category although it should not be confused with it. Investors who are granted work permit through this LMIA will be required to become an employee of their own Canadian company. This means that the company must demonstrate that it is able to pay the “employee” a median wage that meets the province or the territories wage requirements for that occupation as per their National Occupational Classification (NOC) Code.

Steps to Come to Canada on an Owner/ Operator LMIA:

  • You must submit an application to the Employment and Skill Development Canada (ESDC) to obtain a positive LMIA.
  • Once a positive LMIA is issued, the applicant/investor can submit an application for a work permit that is valid for up to 2 years.
  • The last step would be to apply for permanent residence through the Express Entry or Provincial Nominee Programs.

Global Talent Stream

This Stream allows employers to have access to highly skilled global talent and to expand their workforce in Canada to become more competitive in the global marketplace. While this program allows employers to hire highly skilled foreign talent, it operates under two categories, which is either by an endorsement from one of the designated organizations under the program or being hired under an occupation that is listed under one of the listed occupations. Through this program employers can hire an employee much faster compared to the other programs. The applications can be processed in as less as 10 days. Under this program having a Labour Market Benefits Plan is important to demonstrate that the planned business activities will have an impact on the Canadian labour market. Intra Company Transferee

This program allows the temporary movement of qualified employees between the Canadian branch and the overseas branch of the company for the purpose of improving, expanding and enhancing competitiveness in the overseas market. Qualified intra company transferees require a work permit to enter the labour market. Also, they are exempt from the LMIA process since they provide significant economic benefits to the Canadian market by transferring their expertise. Compared to the other programs, this program operates differently as there is a detailed analysis about the company documents and the employee to be transferred.

There are two categories under this program for an employee to be eligible for transfer: they must be transferred to a position which is either an executive or senior managerial role, or have specialized knowledge. To be eligible under this program, the foreign worker must satisfy specific requirements regarding their employment with the overseas enterprise. At Globus, we assist the employer to explore their options in expanding to the Canadian market and assist them in the process of transferring their qualified employees between their enterprises. On the other hand, we assist the employee that is being transferred by submitting applications for them and their accompanying family.

Eligibility Requirements:

  • You must be currently employed by a multinational company and will be working in a parent, a subsidiary, a branch, or an affiliate of the same enterprise
  • You must be transferring to an enterprise that has a qualifying relationship with the enterprise in which they are currently employed
  • You will be undertaking employment at a legitimate and continuing establishment of that company
  • You are being transferred to a position in an executive, senior managerial, or specialized knowledge capacity
  • You must have been employed continuously, by the company that plans to transfer you outside Canada in a similar full-time position for at least one year in the three-years.

Home Support Worker and Home Childcare Provider Pilot

These two pilot programs replaced the live-in caregiver programs. The main objectives of the pilot is that the care provider obtains an occupation specific work permit and this allows the caregiver to change employers. Under this pilot program the caregivers family members can accompany them to Canada and they are eligible to study and/or work in Canada. This pilot program not only offers the caregiver a temporary status in Canada, it also creates a direct pathway for Canadian Permanent Residency upon meeting the requirements. Through this program, you can submit your Permanent Residence application once you have completed the minimum 24 months of qualifying Canadian work experience in the last 36 months

Eligibility Requirements:

  • Be in either NOC Code 4411 or NOC Code 4412
  • 1 year or higher post secondary education
  • Language proficiency results of CLB 5 or higher
  • Ability to perform the task described in NOC Code description in addition to the work experience and education
  • Have a genuine job offer from a Canadian employer that is outside of Quebec

Canada allows residents of some countries to come to Canada and work under three different categories such as Working Holiday, Young Professionals and International Co-op. Caregiver Pilot Programs

Canada provides caregivers two designated pathways for them to apply for Permanent Residence once they meet the eligibility requirements. Foreign caregivers can come to Canada with their accompanying family members under Home Support Worker Pilot and Home Child Care Provider Pilot. Upon meeting the eligibility requirements, caregivers are initially issued an occupation specific work permit, that is not tied to a specific employer. While they are working they can apply for their dependents to work and study for the duration of their work permit.

Eligibility Requirements for Work Permit under the Pilot

  • Must have language proficiency results of CLB 5 or higher
  • Must have Canadian 1 year or higher post secondary education or equivalent
  • Must have the ability and intend to perform the tasks set out in the NOC Codes.
  • Must have a genuine job offer

Steps for Permanent Residency Pathway for Caregivers

  • Submit an application for work permit and permanent residency along with the dependents appropriate forms
  • If the candidate has the qualifying Canadian work experience they may proceed with the PR application, if not, the candidate will be issued a work authorization initially
  • Once the minimum required Canadian work experience is gained, the candidate will be eligible to apply for Permanent Residency both for themselves and their dependents.

Express Entry

Express Entry is a competitive immigration system, ranking all eligible candidates in the pool and then inviting the best ranking candidates to apply for Canadian permanent resident status through a draw. Candidates are ranked against one another based on their Age, Education, Language Proficiency, Work Experience, and other selection factors.

Under Express Entry, applicants will need to be eligible under one of the following 3 main economic immigration programs as well as a select number of Provincial Nominee Programs:

  • Federal Skilled Worker Class
  • Federal Skilled Trades Class
  • Canadian Experience Class
  • Provincial Nominee Programs Express Entry

In order to enter the pool, candidates must qualify under one of the 3 federal economic programs. If you do not meet the minimum criteria for one of them, you may not qualify for the Provincial Express Entry programs either.

Although each program under express entry has different selection factors, there are two common eligibility factors that are:

  • Every candidate must have at least 1 years of work experience, and
  • Every candidate must have sufficient language skills

Before you start your application process there are few things you need to obtain in advance:

1. Language Proficiency Test

All Express Entry candidates must show their language proficiency in either English and/or French. Canada has approved the following language exams:

  • IELTS General
  • CELPIP General
  • TEF (Test d’Évaluation de Français pour le Canada)
  • TCF Canada (Test de Connaissance du Français)

In order to be qualified under any of the Express Entry Programs, the candidates must take a language test and obtain the minimum score as per the program eligibility. The minimum required score varies between the three Express Entry-aligned programs.

2. Employment Reference Letters

For Express Entry applications, you will have to submit an employment reference letter to prove that you have the required work experience as well as to prove that you have completed the main duties of the occupation as per your NOC Code. You will not need to submit your reference letter at the profile creation stage, though obtaining reference letters may be a lengthy process and it is advised that you initiate the process ahead of time.

3. Education Credential Assessment (ECA)

All candidates who have completed their education outside Canada are required to get their educational credential assessed. All candidates must get their ECA report from one of the following designated institutions:

  • Comparative Education Service – University of Toronto School of Continuing
    Studies (CES).
  • International Credential Assessment Service of Canada(ICAS).
  • World Education Services (WES).
  • International Qualifications Assessment Service (IQAS).
  • International Credential Evaluation Service (ICES)

4. Proof of Funds

Proof of Funds is another essential part of your Express Entry application. Depending on whether you have a job offer or not you may need to show the amount of money that is determined by the Government of Canada to support yourself and your family depending on the size of your family. The amount is subject to change by the government and you must meet the current requirements at time of application.

Federal Skilled Worker Program

Federal Skilled Worker Program is designed for candidates who have the relevant work experience, education and language proficiency skills.

Eligibility Requirements:

  • Must have proof of language proficiency results of minimum CLB 7 in all 4 skills.
  • Must have a Canadian secondary or post-secondary degree, or a foreign degree and an Education Credential Assessment (ECA).
  • Must have 1 continuous year of full-time paid work experience in the same job within the last 10 years in a NOC 0, A or B occupation.
  • Must have a minimum of 67 points out of 100 on the six selection factors under FSWP.
  • Must show proof of funds if applicable.

Federal Skilled Trades Program

Federal Skilled Trades Program is for candidates who have the relevant qualification in a skilled trade. Certain skilled trades require to have the proper certification from the province to work in Canada. Eligibility Requirements:

  • Meet the required language proficiency level of CLB 5 in speaking and listening and CLB 4 in reading and writing.
  • Have 2 years of full time (or equivalent) work experience in a skilled trade within the 5 years.
  • Meet the job requirements for the skilled trade under the NOC Code unless you have a provincial or territorial certificate.
  • Have a job offer or a certificate of qualification issued by the province or territorial authority.

Skilled Work Experience

In order to be eligible under this program your occupation must be under certain NOC Codes:

  • Major Group 72: Industrial, Electrical and Construction Trades.
  • Major Group 73: Maintenance and Equipment Operation Trades
  • Major Group 82: Supervisors and Technical jobs in Natural Resources, Agriculture and related production
  • Major Group 92: Processing, Manufacturing and Utilities Supervisors and Central Control Operators
  • Minor Group 632: Chefs and Cooks
  • Minor Group 633: Butchers and Bakers

Canadian Experience Class

Canadian Experience Class offers candidates who have gained Canadian work experience a chance to obtain PR through this program. To be eligible under this program there are certain requirements that must be met.

Eligibility Requirements:

  • Must have a minimum of 1 year of full-time or equivalent paid work experience in NOC 0,A or B in the last 3 years before applying.
  • Must have gained the experience in Canada with a proper authorization (PGWP or work permit)
  • Must have the appropriate language proficiency results. For NOC 0,A the candidate must have CLB level 7 and for NOC B the candidate must have CLB level 5.
  • For this program there is no need to show proof of funds.

Provincial Nominee Programs under Express Entry

Under Express Entry, certain provinces and territories have Express Entry categories that are aligned with the Express Entry eligibility criterias. Most of the time to qualify under the Provincial Nominee Programs that are aligned with Express Entry, the candidate must meet and be eligible for one of the Express Entry Programs. There are multiple ways to apply through Express Entry for PNP’s. You can either create a profile under EE and wait to be selected by the Province or directly apply to the PNP through their EE streams. Either way the candidate must receive nomination from the province in order to be awarded the 600 points. Receiving a nomination or the 600 points is not a guarantee that the candidate will receive a permanent residency status. The process of applying for PNP’s can be very complex and a small mistake may lead to refusal of your application. PNP applications have multiple stages and therefore the application process should be handled delicately as each application stream has different requirements and they must be submitted to the appropriate channel.

  • Meet the requirements of the stream that is being applied to
  • Meet minimum requirements of Federal Skilled Worker Program, Canadian Experience Class or Federal Skilled Trades Program

  • Your child or grandchild must have signed a letter of invitation.

  • The child or the grandchild who is inviting you must prove sufficient funds to support you during this stay.

Business Visitor

Regardless of your reason to visit, all visitors must have a valid visitor visa to enter Canada unless they are from a visa exempt country. If you are from a visa exempt country you must obtain an Electronic Travel Authorization (eTA). Business visitors can conduct meetings and pursue business relations in Canada without the need of obtaining a work permit.

A business visitor does not enter the labour market and therefore is exempt from getting a work permit. As Canada is one of the prime destinations for business people, entrepreneurs and investors, the Government allows them to enter the country to conduct short term business activities such as attending conferences, and providing training.

Visitor Record

A visitor record is not a visitor visa. In order to remain in Canada you need to have a valid temporary visitor visa in addition to your valid status such as study permit or work permit. Visitor records are for people who would like to extend their stay or for those who wish to change their status from a student or a worker to a visitor. It is always important to be aware of the expiry date of your valid status so you may submit your application to extend your stay. It is usually advised to apply for a visitor record at least a month prior to the expiry.
